- VALIDITY OF GENERAL TERMS AND CONDITIONS
The following Terms and Conditions shall apply to all services rendered by TAWASUL LTD., hereafter referred to as Tawasul, in connection with prepaid eSIM reselling. The following Terms and Conditions are provided on the website [tawasulmobile.com]. Tawasul may accept variant clauses only in the case of an explicit written agreement. This section defines various categories of individuals and entities who interact with Tawasul's services, platforms, and applications. Understanding these roles is crucial for interpreting the rights, obligations, and conditions described in these Terms and Conditions (T&C).
- End Users: Individuals who use and interact directly with Services via their Tawasul account for personal use.
- Business Users: Tawasul provides services to entities (“Business Users”) who directly and indirectly provide us with End Customer’s personal information in connection with those Business Users’ own business and activities.
- End Customers: Individuals who receive services ordered by other Tawasul account owners, for example, when you do business with, or otherwise transact with a Business User.
- Job Applicants: Individuals who submit a job application to Tawasul.
The term "Customer" as used throughout this document will refer to any individual or entity engaging with Tawasul's services, including End Users, Business Users, and End Customers, as applicable based on the context of the usage. This broad definition ensures that our T&C encompasses all interactions with our services, providing a clear and comprehensive understanding of the rights and responsibilities of all parties involved.
- DESCRIPTION OF SERVICES
1.1 eSIM Services
Tawasul Ltd. sells prepaid eSIMs with data service plans based on eSIM technology (the “Service”). Tawasul may resell the Service through a Partner or an Agent.
eSIM RESELLING
Tawasul resells prepaid eSIMs. The Customer registers and buys eSIMs on the Tawasul website [tawasulmobile.com] and/or Tawasul App.
2. Terms of Service
2.1. Registration
2.1.1. Customers may register for the Service through our Tawasul App or via our partners or agents.
2.1.2. Customers must provide their First and Last name, along with a verifiable email address, to register. Additionally, customers may upload their profile photo and state their travel preferences. Providing this additional information is voluntary.
2.1.3. Customers must accept the General Terms and Conditions and the Privacy Policies to register for the Service.
2.2. Purchase , Activation and Refund Policy
2.2.1. Tawasul may restrict the availability of plans in certain countries. Customers can browse, select, and purchase our plans on the Tawasul App or via our partners and agents.
2.2.2. By purchasing the Service, customers acknowledge that they have an unlocked, eSIM-compatible device, which is a prerequisite for using the Service.
2.2.3. Upon purchase, customers must download the eSIM onto their device to configure the data plans according to their order. The downloaded eSIM will remain on the device even after the credit has been used or the plan has expired. Customers may choose to remove the eSIM in their phone settings at any time, but it is recommended to keep the eSIM until the plan has been fully used or has expired.
2.2.4. To use the Service, customers must first download the eSIM and then activate the data plan associated with it for the service to begin. Downloading the eSIM and activating the plans may require a stable internet connection.
2.2.5 A refund request can be made within thirty (30) days from the date of purchase when the activation is no longer possible following extensive collaborative troubleshooting .
2.3. Duration and Termination
2.3.1. The Service will begin immediately after a successful eSIM download and activation of the associated data plan.
2.3.2. The duration of the Service will be based on the terms of the plan purchased.
2.3.3. The Service will terminate either when the data plan is fully consumed or when the plan’s duration expires, whichever comes first.
2.3.4. Tawasul may suspend a Customer’s use of the Service in case of a breach of customer obligations mentioned below, with or without prior notice. Tawasul reserves the right to close the account(s) of any Customer and to request proper payment if the Customer attempts to misuse Tawasul’s credits, promotions, and referrals for the Service (the “Program”), breaches any of these Terms & Conditions, or violates any law, statute, or governmental regulation.
2.4. Engagement
2.4.1. The Service is provided on an "as is" and "as available" basis. Tawasul shall take reasonable steps to make the Service available at all times, depending on our and/or our service provider's ability to maintain network capacity and connection availability. However, because Tawasul relies on technology and networks provided by its partners, Tawasul cannot guarantee network coverage, quality, or availability of the Service.
2.4.2. Tawasul partners with other entities to provide the Service. Tawasul is under no obligation to inform the customer if it uses services from such partners. Customers agree to comply with the Terms and Conditions of our partners as well.
2.4.3. The availability of the Service depends on our partners’ ability to maintain network capacity and connection availability, for which there are no guarantees.
2.2. REGISTRATION FOR USING TAWASUL SERVICES
All customers, including End Users, Business Users, End Customers, and Job Applicants as defined in Section 1, must accept the General Terms and Conditions to utilize Tawasul services. During the registration process, the following information must be provided:
- For End Users: Personal information such as First Name, Last Name, and Email address is required for direct interactions and transactions on the Tawasul website or via the Tawasul App.
- For Business Users: Additional information is necessary to accommodate the unique needs of businesses. This includes Company Name, Company Address, Company Users' email addresses, Company Website, Region, Industry, Phone Number, relevant contacts, and other relevant details. This information helps in tailoring our services to better suit the operational requirements and service delivery to their End Customers.
- For End Customers: When services are ordered by another Tawasul account owner, such as a Business User, the necessary information to facilitate this transaction is handled by the initiating party. Business Users are responsible for ensuring that the personal information of End Customers is collected in compliance with applicable data protection regulations.
In instances where Tawasul services are provided through intermediaries (e.g., hotels or travel agencies), the intermediary may provide the required registration information on behalf of the Customer.
To adapt to evolving service requirements and enhance user experience, Tawasul reserves the right to collect additional information from all categories of customers as deemed necessary. This collection of additional information will be conducted in a manner that respects privacy and complies with data protection laws, without necessitating further changes to these Terms and Conditions. Customers will be informed accordingly about the collection of any such additional information through our standard communication channels.
2.3. TAWASUL ENGAGEMENTS
Tawasul shall use reasonable endeavors to provide Customers with quality service. However, Tawasul does not guarantee that the service will not be interrupted, provided on time, or be safe or fault-free.
2.4. CUSTOMER ENGAGEMENTS
In using the Equipment or Services provided by Tawasul, the Customer must not engage in any action that is abusive, illegal, or fraudulent, or that causes the Network to be impaired or damaged. When the Customer breaches its obligations under Sec. 2.4, Tawasul may suspend the Customer's use of the Service. During any period of suspension, the Customer shall continue to pay all Charges due under this Agreement in respect of the suspended Services.
2.5. DEVICE COMPATIBILITY
The Customer is responsible for ensuring that their device is eSIM compatible and network-unlocked. Device compatibility may depend on the carrier and country of origin; the Customer must check the list of eSIM-compatible devices provided at the checkout. By checking the box that confirms that the Customer's device is eSIM compatible, the Customer is then held responsible for the accuracy of the information they provide. The eSIM compatibility list is not exhaustive, meaning newly announced eSIM-compatible devices may still need to be added.
- START, DURATION, AND TERMINATION OF THE CONTRACT
The service contract between Tawasul and the Customer begins upon completing the order on the Tawasul website, via the Tawasul app, through our APIs, on the Partner Platform, or via any other product provided by Tawasul that allows customers to make an order.
The Activation of the eSIM and acknowledgment of the Activation Policy is the Customer's responsibility.
The contract will be terminated for End Users if they do not have an active data package or have deleted the eSIM from the target device. However, for Business Users, the termination of the contract is subject to the terms of any specific agreement signed between the Business User and Tawasul, or their active status on the Partner Platform. For Business Users with such agreements or active platform participation, the contract remains in effect even in the absence of an active data package or if an eSIM is deleted from a device, reflecting the ongoing partnership and commitments between Tawasul and the Business User. - CHARGES AND PAYMENT
4.1. PAYMENT CONDITIONS
Tawasul offers various payment methods for its services, including but not limited to Credit/Debit Card, PayPal, Google Pay, Apple Pay, Stripe.
The currency of payment is in US Dollars ($) and may include various other currencies, with the currency of payment being determined during the transaction.
The credit card transaction will be processed and secured by Tawasul-approved payment service providers, including but not limited to PayPal and Stripe, and additional providers chosen by Tawasul for each transaction.
4.1.1. Automatic Renewals for End Users
Tawasul offers continuous access to our services without the need for manual renewal. This model is intended for End Users seeking uninterrupted service and convenience.
Automatic Charges: Under this model, renewal fees will be charged automatically to the End User's preferred payment method when their available data drops below a certain threshold at the beginning of each billing cycle.
Cancellation Policy: End Users can cancel their renewal at any time. Cancellation will take effect at the end of the current billing cycle, allowing users to continue accessing the service until the cycle concludes. To cancel, users can manage their settings directly within their Tawasul account or contact our support team for assistance.
4.2. CHARGES FOR USE
4.2.1. Invoicing
Tawasul implements a systematic approach to billing Business Users for the utilization of Tawasul Credits, which are employed for the acquisition of eSIMs, top-ups, and other Tawasul products and services via the Partner Platform. This process is designed to ensure clarity and accountability in the financial transactions between Tawasul and its Business Users.
